PGMA-DANDING CONNECTION
  • The July 11, 2003 Sandiganbayan ruling (see details below) came out after Danding had expressed his intent to run in the 2004 elections.

COCO LEVY / SMC / UCPB

  • Coco levy is a tax exacted from coconut farmers from 1973 to 1982. Cojuangco and some Marcos-time officials bought the United Coconut Planters Bank (UCPB) using coco levy funds. UCPB had shares in San Miguel Corporation (SMC), where Cojuangco is also a shareholder.
  • Cojuangco had a 72.2% share in UCPB (95,304 shares).
  • UCPB was the administrator of a block that has a 27% share in SMC. This block is composed of several companies under the Coconut Industry Investment Fund (CIIF)
  • Cojuangco controls another 20% of SMC, apart from UCPB's block of shares.
  • The Supreme Court ruled on December 14, 2001 that coco levy funds are deemed public funds, and that the sequestered UCPB shares were acquired using these funds.
     
  • On July 11, 2003, the Sandiganbayan ruled that Cojuangco and company illegally acquired UCPB during the Marcos years using coco levy funds, and thus forfeited all these shares in favor of the government. The court said Cojuangco did not control UCPB, which in turn holds a stake in SMC.
  • Cojuangco's camp questioned the timing of the July 2003 Sandiganbayan ruling-- it was handed down after he had expressed his intention to run for President in the May 2004 elections.
  • On May 7, 2004, the Sandiganbayan awarded the 27% block of shares of UCPB in SMC to the government.
  • In a visit to Mulanay, Quezon in February 2005, President Arroyo said the government intends to sell its SMC shares to boost the agricultural business in the country.
NPC PARTY STRENGTH/REPUTATION

  • Ravaged by public opinion over its Davide impeachment move as well as by its indecision in the last elections, the party is now a much-reduced force. (Newsbreak)

NPC AND THE DAVIDE IMPEACHMENT

  • NPC decided to give its members a free hand on whom to support for president.
  • Reps. Gilberto Teodoro Jr., Carlos Cojuangco and Mark Cojuangco supported President Arroyo's candidacy. Teodoro is the nephew of Danding Cojuangco; Carlos and Mark are Danding's sons.
  • Reps. Francis Escudero, Darlene Antonino-Custodio and some NPC members supported Fernando Poe, Jr.'s candidacy.
  • NPC members took opposite sides during the joint congressional canvassing of presidential and vice-presidential votes. Escudero was among those protesting alleged widespread cheating; Rep. Ace Durano of Cebu attested to clean and honest elections in his province.
